Terms of Sale and Delivery Conditions

GENERAL TERMS AND CONDITIONS

  1. Applicability
    The terms and conditions of sale apply to all individuals (hereinafter referred to as the Customer) who order goods from the online store www.anatomywear.eu (operated by Anatomy Wear OÜ) and thereby enter into a purchase agreement. Purchases from the www.anatomywear.eu online store can be made by individuals, businesses, and non-profit organizations.
  2. Acceptance
    By accepting these terms, the Customer confirms they have read, understood, and agreed to the terms of the purchase agreement and will comply with them.
  3. Legal Framework
    By registering as a user on glairybrand.com and/or purchasing products, the Customer agrees to these terms and conditions and the applicable rights and obligations arising from the laws of the Republic of Estonia.
  4. Modifications
    Anatomywear.eu reserves the right to amend the terms of sale and pricing. Any changes will be reflected on the anatomywear.eu website.

FORMATION OF THE SALES AGREEMENT

  1. Parties
    Anatomy Wear OÜ sells, and the Customer purchases, the offered products via the online store, phone, email, or direct contact with an authorized representative of Anatomy Wear OÜ.
  2. Agreement Activation
    The sales agreement between Anatomy Wear OÜ and the Customer takes effect:
    • For individual customers, upon receipt of payment into the Anatomy Wear OÜ bank account after order confirmation from the online store.
    • For businesses (payment via invoice), after order confirmation through the online store or acknowledgment of the order by an authorized representative of Anatomy Wear OÜ, either verbally or in writing.

PRICES

  1. Currency and VAT
    All prices in the anatomywear.eu online store are in Euros and include 22% VAT.
  2. Price Adjustments
    Anatomy Wear OÜ reserves the right to adjust prices. Orders submitted before the implementation of price changes are subject to the prices at the time of order placement. Customers are not entitled to claim compensation for price differences.

ORDER PLACEMENT AND PAYMENT

  1. Order Process
    To place an order, add the desired products to the shopping cart. Complete the required fields and choose a suitable delivery method. The total payment amount will be displayed, payable securely through the following methods:
    • Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Bank, Citadele, Pocopay
    • Visa/Mastercard payments
    Note: When paying via bank link, be sure to click the “Return to Merchant” button on the bank’s page.
  2. Payment Handling
    Payments are processed by Maksekeskus AS. Payment occurs outside the online store in a secure environment: bank link payments in the respective bank’s secure environment and credit card payments in Maksekeskus AS’s secure environment. Anatomy Wear OÜ does not have access to the Customer’s bank or credit card details. The agreement is effective upon receipt of payment into the Anatomy Wear OÜ bank account.
  3. Unavailable Products
    If an ordered product cannot be delivered due to stock shortages or other reasons, the Customer will be informed at the earliest opportunity. The payment (including delivery fees) will be refunded promptly but no later than 14 days after notification.

DELIVERY

  1. Regions
    Products are shipped to: Estonia
  2. Delivery Options
    Customers can choose the following delivery methods: DPD parcel machine, Omniva parcel machine, Itella Smartpost parcel machine.
  3. Delivery Costs
    Delivery costs are borne by the Customer and displayed during the selection of the shipping method.
  4. Delivery Time
    Domestic shipments typically arrive at the designated destination within 2-3 working days after the sales agreement is activated. In exceptional cases, delivery may take up to 45 calendar days.
  5. Damaged Goods
    Items damaged during transport (excluding packaging) will be replaced. Customers receiving defective or incomplete products should notify Anatomy Wear OÜ immediately. If replacement is not possible, the cost of the product will be refunded.

RIGHT OF WITHDRAWAL

  1. Withdrawal Period
    Customers may withdraw from the online purchase agreement within 14 days of receiving the order.
  2. Condition of Returns
    Returned goods must be unused, undamaged, and in their original packaging.
  3. Return Costs
    Return shipping costs are borne by the Customer unless the return is due to non-compliance with the order or a defective product.
  4. Return Process
    To return goods, submit a written return request to aw@anatomywear.eu within 14 days of receiving the product. The request must include the Customer’s name, product name, invoice or order number, and the reason for the return.
  5. Refunds
    Refunds will be issued as soon as possible, but no later than 14 days from the receipt of the withdrawal request.

COMPLAINT PROCEDURE

  1. Warranty Period
    Customers have a right to file complaints for two years from receiving the product. For defects occurring within the first six months, the defect is presumed to have existed at the time of purchase, and the seller is responsible for resolving the issue.
  2. Notification
    Notify Anatomy Wear OÜ immediately of any product defects via email at aw@anatomywear.eu, including the Customer’s name, contact details, a description of the defect, and any relevant order or invoice number, along with pictures or videos if possible.
  3. Exclusions
    Anatomy Wear OÜ is not responsible for defects resulting from:
    • Customer negligence or misuse
    • Non-intended use of the product
    • Normal wear and tear

LIABILITY AND FORCE MAJEURE

  1. Liability
    Anatomy Wear OÜ and the Customer are liable for damages resulting from breaches of these terms in accordance with the laws of the Republic of Estonia.
  2. Force Majeure
    Anatomy Wear OÜ is not liable for delays or damages caused by circumstances beyond its control or unforeseeable events.

PRIVACY

  1. Consent
    By using the anatomywear.eu website, the Customer consents to the processing of their personal data by Anatomy Wear OÜ.
  2. Use of Data
    Anatomy Wear OÜ uses the information provided by the Customer solely for fulfilling orders and does not disclose it to third parties.

DISPUTES

Disputes arising from these terms will be resolved primarily through negotiation. If no agreement is reached, Customers may contact the Consumer Protection Board or the courts. Anatomy Wear OÜ may also seek legal remedies through the courts.
